Judge Dismisses Racketeering Case Against RIAA

Riaa Good news for the RIAA: Its record lables won't go down like members of the mafia.

U.S. District Judge Anna J. Brown has thrown out a lawsuit against the recording industry's trade group that was brought under RICO statutes. An Oregon woman named Tanya Andersen had taken the RIAA to court for racketeering in connection with falsely suing thousands of innocent individuals for copyright infringement.

In this order, Judge Brown said that Anderson could re-file an amended complaint, but advised that her claims have to reach much higher requirements of the Racketeering Influenced and Corrupt Organizations Act, such as showing the RIAA's litigation threats rise to the level of a "sham."

What is the level of a sham?
